These Terms of Service ("Terms") govern your use of the Keystone Web Systems website at keystonewebsystems.co.nz ("the Site"). By using the Site you agree to these Terms. If you do not agree, please stop using the Site.
1. About Keystone Web Systems
Keystone Web Systems is a New Zealand-based studio that designs, builds and hosts websites for small businesses.
2. Use of this website
You may use the Site for lawful personal and commercial purposes. You agree not to:
- Use the Site in any way that violates applicable New Zealand law or regulation.
- Attempt to gain unauthorised access to any part of the Site or its underlying systems.
- Introduce malware, viruses, or any harmful code.
- Scrape, copy, or reproduce Site content at scale without our written permission.
- Use the Site to transmit unsolicited commercial communications.
3. Client work
Website design, build and hosting work is quoted and agreed in writing before it starts. That quote or agreement sets out the scope, price, timing and ownership of the finished site, and it takes precedence over these Terms where the two differ.
Website concepts shown on this Site for prospective clients are unsolicited samples. They are not affiliated with, or endorsed by, the businesses they are made for, and they are kept out of search engines.
4. Intellectual property
All content on the Site — including text, graphics, logos, icons, images, and software — is owned by or licensed to Keystone Web Systems and is protected by New Zealand and international copyright law. You may not reproduce, distribute, or create derivative works from this content without our prior written consent.
An exception applies to content you submit to us (such as the text, photos and logos in a project brief): you retain ownership of that content but grant us the licence necessary to use it in the work you ask us to do.
5. Third-party links and services
The Site may contain links to third-party websites or services. We have no control over those sites and are not responsible for their content, privacy practices, or availability. Linking to a third-party site does not imply endorsement.
We use third-party services including Cloudflare (hosting and security), Resend (form email delivery), and Cloudflare Turnstile (spam prevention). Use of these services is subject to their own terms and privacy policies.
6. Disclaimer of warranties
The Site is provided on an "as is" basis. To the extent permitted by law, we make no warranties — express or implied — about the accuracy, completeness, reliability, or availability of the Site or its content. We do not warrant that the Site will be uninterrupted or error-free.
7. Limitation of liability
To the maximum extent permitted by the New Zealand Consumer Guarantees Act 1993 and Fair Trading Act 1986, Keystone Web Systems will not be liable for any indirect, incidental, special, or consequential loss arising from your use of the Site. Our total liability for any claim arising from the supply of products or services will not exceed the amount you paid for that product or service.
Nothing in these Terms limits or excludes any guarantee, right, or remedy you have under New Zealand consumer law that cannot be excluded.
8. Changes to these Terms
We may update these Terms from time to time. Changes take effect when published on this page. Continued use of the Site after changes are published constitutes acceptance of the updated Terms.
9. Governing law
These Terms are governed by the laws of New Zealand. Any dispute arising under these Terms will be subject to the non-exclusive jurisdiction of the New Zealand courts.
